Love Your Body™ Club Terms and Conditions

Valid from 18 March 2022

Welcome to Love Your Body™ Club (“LYBC”) loyalty programme operated by The Body Shop International Limited (“The Body Shop”, “we” or “us”) in Hong Kong & Macau (the "programme").  Please read these terms and conditions carefully. By joining and participating in the programme, you agree to be bound by the below terms.

  1. Participation
    1. All members of the programme must be aged 16 years or over.
    2. To join the programme, you must have a valid email address and mobile number. It is your responsibility to keep The Body Shop updated if your email address and mobile number or other contact information changes. We cannot be held responsible for any loss of points or Rewards (as defined below in clause 3(b)) incurred as a result of out-of-date details.
    3. Each Member is only entitled to one programme account. The Body Shop reserves the right to refuse, merge or close additional accounts at any time.
    4. Your membership is for personal use only and we may in our sole discretion refuse any applications or terminate a membership and/or cancel or reduce points at any time if we consider your transactions to be excessive and/or are for commercial or non-domestic purposes or subject to onward sale or delivery.
    5. The LYBC programme, account, Rewards and points, in whatever form, are issued by and remain the property of The Body Shop.
    6. The LYBC programme, account, Rewards and points are only valid for use in the Hong Kong & Macau or when shopping online at The Body Shop Hong Kong official website (if applicable).
       
  2. Usage
    1. You may collect points and redeem your Rewards when shopping at any of The Body Shop outlets in the Hong Kong & Macau except The Body Shop outlet  at Citygate in Tung Chung.
    2. The points and Rewards have no cash value and may not be exchanged for cash.
    3. You need to share your mobile number or email address and present identification with your name registered for the Programme when you want to collect points or redeem your Rewards in store. From time to time, we may ask you to prove your identity to ensure that the account is not used fraudulently or otherwise in breach of the terms and conditions, and to ensure the identity of the individual using the account.  
    4. Programme accounts, points and Rewards cannot be transferred, bought, sold or in any way traded.
    5.  You can check your points and Rewards in-store or by logging into My Account at The Body Shop Hong Kong website at  https://www.thebodyshop.com/en-hk/login. In case of any inconsistency between the membership points reflected in your Love Your Body™ Club membership account and our internal records, the latter shall prevail.
       
  3. Points and Rewards
    1. There are 2 membership tiers, basic tier namely “CLUB” and higher tier namely “FAN”. All new customers will join as CLUB. CLUB membership will be automatically upgraded to FAN membership when $600 net spend is accumulated during the CLUB membership year. FAN membership is valid for one year. FAN membership is automatically renewed for one year when a minimum net spend of $600 is accumulated during the FAN membership year, otherwise will be renewed as CLUB. CLUB membership is renewed automatically every year.
    2. For every $1 spent at The Body Shop in a transaction using your account, both CLUB and FAN members will earn 1 loyalty point. For every 600 points that you earn, your account will automatically be converted into a voucher to the value of $30 (“Reward”).
    3. Points earned and/or redeemed will be updated on your Love Your Body™ Club membership account within 3 days of your transaction.  In case of any inconsistency between the points reflected in your membership account and our internal records, the latter shall prevail.
    4. Unless otherwise indicated, points are earned on all purchases except gift cards, gift certificates, delivery charges and carrier bags (if applicable).
    5. Your entire balance of points will expire at the end of the 12 months of the membership period. All expired points will be eliminated by system without prior notification and will not be returned thereafter.
    6. Points of 1 – 599 which are not converted to $30 voucher will be expired after membership is renewed or downgraded and can no longer be available for redemption.
    7. Points that accumulate to 600 will automatically be converted to $30 voucher (“Rewards”) and the voucher will be valid for 60 days from date of issue. All expired vouchers will be eliminated by system and will not be returned thereafter.
    8. Points will be removed from your balance for any transactions with returned or refunded products.
    9. Each Reward can only be used once towards the partial or full payment of products. Any remaining value of a partially used Reward will not be refunded.
    10. A maximum of ten (10) Rewards can be redeemed per transaction.
    11. Rewards can be used in conjunction with other promotions, offers or discounts unless otherwise stated.
    12. Unless otherwise indicated, Rewards can be used to purchase any The Body Shop products, except gift cards, gift certificates, delivery charges or carrier bags (if applicable).
    13. Photocopied Rewards will not be accepted.
    14. Birthday Reward – If you have provided your birthdate to us, you can enjoy a one-time double point on the first transaction in your birthday month. Each member can enjoy once each year. Birthday Rewards will expire after birthday month if unspent.
    15. FAN members can enjoy 10% off regular priced products during FAN membership year.
    16. The currency ($) refers to HK Dollar (HKD) / Macau Pataca (MOP). Exchange Rate HKD 1 = MOP1.
       
  4. Termination and Expiry
    1. The Body Shop reserves the right to terminate your participation in the programme: (a) if The Body Shop believes that the use of your account is unauthorised, fraudulent or otherwise unlawful; (b) for any behaviour relating to the programme or The Body Shop that involves theft, misconduct, abusive or offensive behaviour, or supplying false or misleading information; or (c) for any breach of these terms and conditions.
    2. You can end your participation in the programme at any time by sending an email to Customer Services on HK.ENQUIRY@thebodyshop.com or contact +852 2542 6322.
    3. Upon termination or expiry of your account, all points and Rewards already accrued or issued will be cancelled.
       
  5. Modification and Termination
    1. The programme terms and conditions, member benefits, FAQs, or any other descriptions of the programme are subject to change at any time.  
    2. The Body Shop further reserves the right to terminate, discontinue or cancel the programme at any time and in its sole discretion.   Any changes, modifications, or termination of any part of the programme or its terms will be effective immediately upon publication of those changes on The Body Shop website.
    3. Your continued participation in the programme will confirm your acceptance of such changes or modifications; therefore, you should review these terms and conditions and applicable policies frequently to understand the terms and conditions that apply to the programme. If you do not agree to the amended terms, you must stop participating in the programme.
       
  6. Personal Information and Marketing
    1. We will use your personal information to manage your membership of the programme, for sales and marketing analysis and to personalise your marketing experience (where appropriate).     2. If you have opted-in to receiving marketing from us, we will contact you from time to time to send you marketing communications and keep you up-to-date with our products, promotions and special offers and with general information concerning The Body Shop. You may unsubscribe from receiving such marketing communications at any time by clicking on the “unsubscribe“ link found on any marketing emails from us, logging into  My Account at The Body Shop Hong Kong website or by contacting Customer Services with your request.
    3. If you have not opted-in to receive marketing from us, we will only contact you with service information in relation to your account.
       
  7. Free WiFi Service Terms and Conditions
    1. The Body Shop WiFi (“Service”) will be provided, free of charge, for all existing Love Your Body™ Club members and customers who are signing up for the membership in The Body Shop® stores (each a “Customer”).
    2. Dealings that the Customer may have with promotions, services or merchants via the Service are solely between the Customer and the person with whom they are dealing. The Body Shop does not warrant or guarantee the suitability of the Service for any specific application or purpose intended by the Customer, that products or services or any websites accessible via the Service are error or virus free, or that the performance of the internet or that the transmission of information over the internet will be secure, uninterrupted or free from errors, or that the internet will be accessible at all times or at the speeds indicated.
    3. Signal strength may vary or fail altogether due to certain factors which are not within the control of The Body Shop, including, but not limited to, building structure, building material, natural or artificial barriers, electrical or electromechanical interference and/or weather conditions. The Body Shop shall not be liable for any loss or damage arising from such interference or failure. The speed range may vary between users and is subject to device used, hardware and software limitation, distance between user and WiFi access point, source of website and other external factors.
    4. The Body Shop reserves the right at its absolute discretion to discontinue and/or suspend the Service whether in whole or in part without any liability whatsoever to the Customer.
    5. The Body Shop shall not be liable to the Customer for any loss, liability, costs and/or damage whatsoever (whether direct, indirect or consequential) in respect of any matter howsoever arising (whether in tort, negligence or otherwise) in connection with the provision and/or use of the Service.
    6. The Customer agrees not to use the Service in violation of any laws or regulations applicable from time to time; or to misuse the Service in any manner deemed inappropriate by The Body Shop; or to allow any use of the Service to interfere with other users' access to and use of the Service.
    7. The Body Shop reserves the right to amend these terms any time without prior written notice to the Customer.
       
  8. General
    1. These terms and conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute or claim arising out of or in connection with these terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Hong Kong courts.
